We are pleased to announce that partners Charles L. Bach, Jr., Alejandra R. Gil, and Greg Freedman have published an article with the Medical Professional Liability (MPL) Association. 

Their article examines the New York Court of Appeals’ recent decision in SanMiguel v. Grimaldi, a closely watched 4–3 ruling that reaffirmed longstanding limits on emotional distress damages in obstetrical malpractice cases, including claims based on lack of informed consent. The decision preserves the precedent established in Sheppard-Mobley v. King and carries significant implications for healthcare providers, medical centers, insurers, and malpractice litigation throughout New York State. 

The authors also explore the broader legal and policy considerations surrounding the decision, including its potential impact on professional liability exposure and obstetrical care in New York.
