Summary Judgment Secured in Birth Injury Defense Case

Partner Gabrielle DeYoung and Of Counsel Corey Schmit obtained summary judgment on behalf of our obstetrician client in a birth injury case venued in Supreme Court, Suffolk County.

The motion for summary judgment was supported by expert affirmations in maternal fetal medicine, pediatric neurology and neuroradiology.

Based on our moving papers, the Court found that our team established that the vacuum assisted delivery was performed correctly; and the infant-plaintiff developed normally without any injury, and this further established that no malpractice occurred during the delivery of the infant.
