Summary Judgment Dismissal

Congratulations to HPM&B Attorneys Gabrielle DeYoung and Natalie Hermon for obtaining summary judgment dismissal in a case involving a pedestrian automobile accident. Plaintiff alleged a pothole in the roadway was created by our client, which caused him to pull over to the side of the road to check his tires. While he was leaning into his trunk to check for a spare tire, another driver hit him and pinned him between the two vehicles. He required an amputation of one leg and surgery on the other leg. Although plaintiff claimed to suffer from catastrophic injuries, Ms. DeYoung and Ms. Hermon successfully argued that our client did not cause nor create the pothole, that the accident was not reasonably foreseeable, and there is no evidence the accident was even caused by the pothole. The Court agreed and awarded summary judgment dismissal in our client’s favor.
