HPMB Secures Voluntary Discontinuance in Scoliosis Surgery Case

HPMB obtained a voluntary discontinuance for an internationally renowned spine surgeon and a premier orthopedic institution. Plaintiff alleged improper performance of surgery to address scoliosis, resulting in the need to undergo a revision procedure.

 

After completing discovery, the defendants moved for summary judgment.  Collectively, the defendants’ experts opined that the scoliosis surgery was performed properly and the need for the revision was a well-known risk of the procedure.

 

In the face of the defendants’ comprehensive motion and compelling expert support, which thoroughly addressed and refuted each of plaintiff’s allegations, plaintiff elected not to submit any opposition and instead discontinued the action in its entirety.
