Dismissal in Nassau County

This Nassau County neurologically impaired infant case was dismissed on December 17, 2009.  Infant-plaintiff, by her mother, initiated this action against an obstetrician and a prominent hospital for allegedly negligent intrapartum care. 

After birth, infant-plaintiff was healthy and transitioned well into extrauterine life.  Sometime later, infant-plaintiff sustained significant neurological injuries after developing a large intracranial hematoma and bilateral retinal hemorrhages.  He was left with a seizure disorder, blindness, and severe cognitive and motor delays.  Sadly, we discovered that infant-plaintiff’s father physically abused infant-plaintiff, leading to all of the claimed injuries.  Accordingly, we moved to dismiss all of the claims and that motion was granted.
