Discontinuance of All Claims in Nassau County

All claims against an acclaimed medical center discontinued on May 11, 2005 after we moved to dismiss them because the plaintiff failed to report the claims as potential assets when he filed for bankruptcy.

In this Nassau County action, then 41-year-old plaintiff claimed that a neurosurgeon and the staff at the medical center negligently failed to timely diagnose and properly treat a cervical infection.  Consequently, the infection allegedly progressed into the vertebral spaces from C3-through-T2, required more extensive treatment, and caused severe and permanent neurological injuries.  Plaintiff decided to discontinue the claims before the court ruled on the motion to dismiss.
