Defense Verdict Received In Kings County

On May 2, 2013, Darshan I. Patel obtained a defense verdict in Supreme Court, Kings County on behalf of his client, a urologist in private practice in New York City.

Plaintiff reported complaints of acute testicular pain and difficulty walking for nearly 30 hours.  He rated his pain as an “8” on a scale of 1-10 and he reported that his left testicle had swollen “to the size of an egg.”  Plaintiff was diagnosed with epididymitis but he claimed that HPM&B’s client negligently failed to refer him for an ultrasound to rule out a testicular torsion.  Testicular torsion is an emergency medical condition involving an abnormal twisting of the spermatic cord that cuts off blood supply to the testicle.  Plaintiff lost his left testicle and sought recovery for damages.

At trial, Mr. Patel introduced testimony by an expert in urology.  The expert testified that our client appropriately ruled out a testicular torsion by examination and history and that an ultrasound was not necessary.  The defense expert also opined that the medical evidence did not support the plaintiff’s presumed diagnosis of a testicular torsion and that the plaintiff’s outcome was attributable to an infectious process.
