Defense Verdict in Queens County Medical Malpractice Action

A Queens County jury determined that a board-certified otolaryngologist/head and neck surgeon met the standard of care when he treated a patient with recurrent olfactory neuroblastoma. This rare cancer of the sinus had recurred in this patient on four occasions by the time of trial. Through the testimony of a nationally renowned Head and Neck surgical expert, Head and Neck neuroradiologist and the Head and Neck surgeon, HPM&B senior partner Charles Bach established that there was appropriate clinical follow-up after a CT scan of the patient’s sinuses demonstrated a mucous retention cyst that was considered unusual. Plaintiff’s counsel sought $2 million in damages and a jury returned a defense verdict in 19 minutes following three weeks of trial.  This was the second defense verdict obtained by Mr. Bach in 2019.
