Complete Dismissal Secured in Federal Civil Rights Litigation

The HPMB New York City legal defense team secured a complete dismissal of a federal civil rights action in the Southern District of New York, with Judge Naomi Reice Buchwald granting a motion to dismiss filed by Rosalie Tanis.
In a 23-page decision, the Court rejected plaintiff’s § 1983 deliberate indifference claims, finding no plausible allegations of personal involvement by City defendants and no basis for municipal liability under Monell.
The Court also dismissed plaintiff’s ADA and state law claims, holding that the allegations failed as a matter of law and were, in part, time-barred.
Importantly, the Court emphasized that conclusory allegations and generalized claims against defendants were insufficient to survive Rule 12(b)(6) scrutiny.
The case was dismissed in its entirety, despite plaintiff’s opposition, marking a significant early-stage victory for the city.
