Administrative Hearing Victory

Charles Bach and Tom Grove recently prevailed at an administrative hearing involving the restriction of a physician’s surgical privileges on behalf of a major teaching hospital in New York.

During three days of hearing testimony over two months, Mr. Bach and Mr. Grove successfully established through expert and eyewitness testimony by members of the hospital staff that the decision to restrict the physician’s surgical privileges was founded in fact and not arbitrary and capricious.

The Hearing Board agreed and unanimously affirmed the underlying restriction of the physician’s surgical privileges.
