Bronx Supreme Court Grants Summary Judgment for Major Bronx Hospital in Premises Liability Case

In a decision issued on April 7, 2026, Justice Guzman in Bronx County Supreme Court granted our summary judgment motion submitted on behalf of one of the largest hospitals in the Bronx area in a general liability case in which plaintiff claimed to have suffered injuries to her knees and back as a result of what she claimed was a defective “lip” in the top step of a stairwell at our facility.
Judge Guzman decided that plaintiff’s testimony that there was a “lip” was insufficient to create a triable issue of fact and defeat our prima facia showing of entitlement to summary judgment based on our submissions, which included testimony by a maintenance worker and an inspection report of an engineer who also inspected the steps and likewise concluded there was no defect.
