Case Dismissal

Congratulations to Partner Rachel Bloom, Of Counsel Corey Schmidt, and Associate Elise DeNatale, Esq. for securing a complete dismissal in a complex tort action in Nassau County Supreme Court.

The case, brought by pro se plaintiffs residing outside the United States, involved highly unusual claims arising from alleged child abduction, asylum fraud, forgery, and child neglect and abuse. The plaintiff-father and infant-plaintiff claimed our client, a Board-certified Pediatrician, improperly prescribed medication, was complicit in improperly sedating the infant, forged medical records, and failed to act as a mandated reporter.

Our team successfully defended against a barrage of motions and novel discovery demands filed by the plaintiffs, involving requests for poor person relief, amendments to add claims under New York Social Services Law, Penal Law, and various federal regulations, and discovery demands pertaining to international materials and unsupported legal theories.

We also moved to dismiss the case based on multiple grounds, including lack of proper service and jurisdiction, lack of legal capacity to sue, failure to state a cause of action, and the pursuit of improper derivative claims. The court agreed and dismissed the case in its entirety. This was a great result in a truly one-of-a-kind case. Well done to the team!
