Charles Bach is a senior partner at HPM&B who has successfully defended major pharmaceutical companies, university medical centers and healthcare professionals in complex litigation for more than 25 years. He has won numerous jury trials for clients whose exposure exceeded $10 million. Mr. Bach has handled a myriad of products liability and mass tort claims involving prescription drugs such as Baycol®, birth control pills and Ciprofloxacin®, over-the-counter drugs such as phenylpropanolamine (PPA), factor concentrates, RhoGAM®, and medical devices.

Mr. Bach was a member of the defense team that succeeded in obtaining Frye/Daubert dismissals of hundreds of cases against Bausch & Lomb for allegedly defective manufacture of contact lens solutions. He was appointed lead counsel in 60 consolidated lawsuits by or on behalf of hemophiliacs who claimed that blood factor concentrates caused HIV and Hepatitis C infections.

Mr. Bach has tried to favorable verdict dozens of medical malpractice cases in state and federal court on behalf of New York’s leading medical institutions and physicians. Many of these cases involved catastrophic losses, potentially exposing his clients to multi-million dollar judgments. Recently, Mr. Bach successfully defended a major university medical center in an Indiana state court case alleging corporate negligence on the part of its Institutional Review Board arising from a clinical study.

His landmark appellate victories include McDougald v. Garber 73 N.Y.2d 246 (1989) [loss of enjoyment of life not a separate item of damages and plaintiff must prove awareness to recover for pain and suffering including loss of enjoyment of life] and Landon v. Skog, 65 N.Y.2d 639, 491 N.Y.S.2d 607 (1985) [physician’s duty of reasonable care owed solely to his patient and not extended to family members including parents of child infected with a contagious disease]. Other significant reported cases include Scher v. Bayer, 258 F.Supp. 2d 190 (EDNY 2003) [New York’s blood shield statute applied to a commercial distributor of RhoGAM®, a derivative of human blood, thereby eliminating any possibility of recovery on a strict products liability theory] and Doe v. Hyland Therapeutics, 807 F.Supp. 1117 (SDNY 1992) [forum non conveniens dismissal of claims by 81 Irish hemophiliacs suing pharmaceutical companies in New York District Court].

For the first four years of his legal career, Mr. Bach handled appeals and felony trials as a prosecutor in the Office of the District Attorney, Bronx County. He graduated Albany Law School of Union University in 1977 where he was an Editor of the Law Review.
